Selling at a Higher Price on Credit Compared to Cash Payment

What do the respected scholars and honorable Muftis say regarding the following issue: A person is a shopkeeper who sells an item for 20 rupees if paid in cash, and for 25 rupees if sold on credit. However, the buyer is not informed that an item worth 20 rupees in cash is being given to him for 25 rupees on credit. Is such a transaction valid according to Shari‘ah or not? Kindly provide a detailed explanation with evidence.

الجوابُ حامِدا ًو مُصلیِّا ً

Selling at a higher price on credit compared to cash is permissible in Shari‘ah, provided that during the contract session, both the price and the mode of payment — whether the sale is on cash or credit — are clearly specified and agreed upon.

مأخَذُ الفَتوی

کما فی مصنف عبد الرزاق الصنعاني: وعن قتادة، عن ابن المسيب قالوا: " لا بأس بأن يقول: أبيعك هذا الثوب بعشرة إلى شهر أو بعشرين إلى شهرين، فباعه على أحدهما قبل أن يفارقه فلا بأس به " اھ (8/ 136)
و في المبسوط للسرخسي؛ وإذا عقد العقد على أنه إلى أجل كذا بكذا وبالنقد بكذا أو قال إلى شهر بكذا أو إلى شهرين بكذا فهو فاسد لأنه لم يعاطه على ثمن معلوم ولنهي النبي صلى الله عليه وسلم عن شرطين في بيع وهذا هو تفسير الشرطين في بيع ومطلق النهي يوجب الفساد في العقود الشرعية وهذا إذا افترقا على هذا فإن كان يتراضيان بينهما ولم يتفرقا حتى قاطعه على ثمن معلوم وأتما العقد عليه فهو جائز لأنهما ما افترقا إلا بعد تمام شرط صحة العقد.
