What do the respected Muftis say regarding this matter: I sold my car to my brother, handed it over to him, and he paid me the full amount, but the car was not transferred to his name. Later, he sold the car to a third person on installments, and that third person has paid some installments but is unable to pay the remaining amount. Now, that third person wants to sell the car back to me. Can I purchase the car from him?
If the mentioned third person, after taking possession of the car, is selling it back to the first seller (the original owner) due to some compulsion arising from his inability to pay the remaining installments, and there is no invalid condition attached to this sale, then it is permissible and valid for the questioner to purchase the said car again.
كما في حاشية ابن عابدين (رد المحتار): (قوله: في بيع العينة) اختلف المشايخ في تفسير العينة التي ورد النهي عنها. (إلی قوله) وقال بعضهم: هي أن يدخلا بينهما ثالثا فيبيع المقرض ثوبه من المستقرض باثني عشر درهما ويسلمه إليه ثم يبيعه المستقرض من الثالث بعشرة ويسلمه إليه ثم يبيعه الثالث من صاحبه وهو المقرض بعشرة ويسلمه إليه، ويأخذ منه العشرة ويدفعها للمستقرض فيحصل للمستقرض عشرة ولصاحب الثوب عليه اثنا عشر درهما، كذا في المحيط، وعن أبي يوسف: العينة جائزة مأجور من عمل بها اھ (5/ 273)۔
