Ruling on Pronouncing “Divorce, Divorce, Divorce”

What is the ruling if, during a dispute between husband and wife, the husband impulsively says the word ‘divorce’ three times without mentioning the wife by name?

الجوابُ حامِدا ًو مُصلیِّا ً

It should be clarified that if, during a dispute with his wife, the husband utters the words “divorce, divorce, divorce” three times, even without mentioning his wife by name, then three divorces take effect upon the wife and irrevocable separation (hurmat-e-mughallazah) is established. After this, neither reconciliation (ruju) is valid nor can a new marriage contract between them take place without a valid Halalah Shariyyah, provided that valid seclusion (khalwah sahihah) or marital relations had already occurred between them. While after completing her waiting period (ʿiddah), the woman is also free to contract marriage elsewhere.

کما فی الھندیہ : متى كرر لفظ الطلاق بحرف الواو أو بغير حرف الواو يتعدد الطلاق ( کتاب الطلاق، الباب الثانی، الفصل الاول فی الطلاق الصریح، ج :1 ، ص : 356 ، ط : ماجدیہ )
و فی بدائع الصنائع : وأما الطلقات الثلاث فحكمها الأصلي هو زوال الملك، وزوال حل المحلية ..الی قولہ سواء طلقها ثلاثا متفرقا أو جملة واحدة. ( کتاب الطلاق ، فصل فی حکم الطلاق البائن ، ج :3 ، ص : 187 ، ط : دار الکتب العلمیۃ)
وفی ردالمختار تحت قولہ : ( لترکہ الاضافۃ ) ولا یلزم کون الاضافۃ صریحۃ فی کلامہ ، لما فی البحر لو قال طالق فقیل لہ من عنیت ؟ فقال امراتی طلقت امراتہ ھ( باب الصریح ، ج : 3 ، ص : 248 ، ط : سعید )
