What is the view of the scholars of Islam regarding the following issue: Can Zaid’s sister-in-law receive Zakat (obligatory charity)? The reason is because she doesn’t own anything. She got married one year ago and her husband sold out her jewellery for his business. She lives with a child in a room at the top of her in-laws home. It’s very difficult for her to live without A.C in the intense heat. In this situation, can Zaid give his sister-in-law an A.C unit as Zakat?
If Zaid’s sister-in-law is truly deserving of Zakat (i.e she doesn’t own 52.5 تولہ silver or its value, neither is she of the linage of the household of the Holy Prophet Muhammadﷺ) then it is permissible to give her an A.C unit as Zakat.
ففي الدر المختار: (ولا) إلى (من بينهما ولاد)
وفي حاشية ابن عابدين: وقيد بالولاد لجوازه لبقية الأقارب كالإخوة والأعمام والأخوال الفقراء بل هم أولى؛ لأنه صلة وصدقة. (2/ 346)
وفي بدائع الصنائع: ويجوز دفع الزكاة إلى من سوى الوالدين والمولودين من الأقارب ومن الإخوة والأخوات وغيرهم؛ لانقطاع منافع الأملاك بينهم ولهذا تقبل شهادة البعض على البعض اھ(2/ 50)
