Issuing the third divorce one year after giving two divorces.

Sir, I want to know whether my divorce has taken place or not. I had already obtained a fatwa last year, according to which two of our rights had ended. Now, on 18th April, my husband called me twice on the phone in anger and said twice, ‘I am giving you divorce.’ I want to know if my divorce has taken effect. According to him, it has. Please issue me a fatwa which I can also submit to NADRA, so that it may help me in future proceedings. I am attaching the previous fatwa as well.

الجوابُ حامِدا ًو مُصلیِّا ً

According to the attached Fatwa No. 69703, when the husband of the questioner gave her two divorces in writing one year ago using clear words such as, ‘I give you divorce,’ and thereafter reconciled with her during the ‘iddah (waiting period), then that reconciliation was valid according to Shariah. Consequently, only one divorce right remained with the husband. Therefore, in the recent incident, when the husband of the questioner , in a state of anger, pronounced the words of divorce twice over the phone, this resulted in the occurrence of the third divorce. With the completion of all three divorces, the hurmat e mugallazah (irrevocable prohibition of re-marriage between them) has been established. As for a fourth divorce, since the place for it does not exist, it is considered void. Thus, now reconciliation is not possible, and re-marriage between them cannot take place without a proper halala e shariah. After completing her iddah, however, the questioner will be free to contract marriage elsewhere.

مأخَذُ الفَتوی

کمافی تنزیل القرآن : {فَإِنْ طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ)،(البقرہ :230)۔
وفي صحيح البخاري: عن عائشة،" ان رجلا طلق امراته ثلاثا فتزوجت، فطلق، فسئل النبي صلى الله عليه وسلم: اتحل للاول؟ قال:لا حتى يذوق عسيلتها كما ذاق الاول".(5261)۔
وفی بدائع الصنائع : وأما الطلقات الثلاث فحكمها الأصلي هو زوال الملك، وزوال حل المحلية أيضا حتى لا يجوز له نكاحها قبل التزوج بزوج آخر؛ لقوله - عز وجل - {فإن طلقها فلا تحل له من بعد حتى تنكح زوجا غيره}، وسواء طلقها ثلاثا متفرقا أو جملة واحدةاھ (3/187)۔
وفی الھندیہ: وعدة الحامل أن تضع حملها كذا في الكافي. سواء كانت حاملا وقت وجوب العدة أو حبلت بعد الوجوب كذا في فتاوى قاضي خان اھ(1/528)۔
