Lending money and, in exchange, obtaining a discount on the rate.

Respected Mufti Sahib, I am engaged in the sand business and supply material to a block factory. At present, I am in urgent need of some money, and I have no other source from which to obtain it. Therefore, I approached the factory owners and made a request. They told me that whatever amount I require, they will give me in advance. This amount will remain with me as their trust, and in return, I will grant them a small additional discount on the current rate. They will demand repayment of this advance once the work is completed, and for the rest of the supplies delivered by truck, the payments will be made in full according to the total bill. I therefore request you to kindly let me know whether this arrangement is permissible according to Shariah, or suggest some alternative solution. I would be very grateful. Thank you.

الجوابُ حامِدا ًو مُصلیِّا ً

It is not permissible to give a loan under the name of trust (amanat) and, in return, obtain an additional discount in the rate through the mentioned method. However, if they give the mentioned amount, and the questioner without any prior agreement, offers some concession in the rate purely as a gesture of goodwill, then that is permissible.

مأخَذُ الفَتوی

کمافي الأشباه والنظائر لابن نجيم: كل قرض جر نفعا حرام اھ (ص: 226)۔
وفي المبسوط للسرخسي: وهذا هو الأصل؛ ولهذا قلنا: إن المنفعة إذا كانت مشروطة في الإقراض فهو قرض جر منفعة وإن لم تكن مشروطة فلا بأس به اھ (14/ 35)۔
وفي الفتاوى الهندية: إذا أقرض رجلا دراهم أو دنانير ليشتري المستقرض من المقرض متاعا بثمن غال فهو مكروه وإن لم يكن شراء المتاع مشروطا في القرض ولكن المستقرض اشترى من المقرض بعد القرض بثمن غال فعلى قول الكرخي لا بأس به اھ (3/ 203)۔
وفي الفقه الإسلامي وأدلته للزحيلي: القرض الذي جرّ منفعة: قال الحنفية في الراجح عندهم: كل قرض جر نفعاً حرام إذا كان مشروطاً، فإن لم يكن النفع مشروطاً أو متعارفاً عليه في القرض، فلا بأس به اھ (5/ 3793)۔
