The Ruling on Divorce Upon Saying: You Are Not My Wife

What do the esteemed Islamic scholars and honorable muftis say regarding the following issue: One day, I accidentally uttered the words: "You are not my wife." I had absolutely no intention of issuing a divorce. What is the ruling of Shariah in this matter?

الجوابُ حامِدا ًو مُصلیِّا ً

If the questioner's intention was indeed not to issue a divorce when he uttered these words, then, according to Islamic law, no divorce has taken place. The couple may continue to live together as husband and wife as before. However, in the future, he should exercise caution and avoid using such words.

مأخَذُ الفَتوی

كما في الدر المختار: لست لك بزوج أو لست لي بامرأة. أو قالت له لست لي بزوج لست لك بزوج أو لست لي بامرأة. أو قالت له لست لي بزوج اھ (3/ 282)۔
و في حاشية ابن عابدين (رد المحتار)؛ (قوله طلاق إن نواه) لأن الجملة تصلح لإنشاء الطلاق كما تصلح لإنكاره فيتعين الأول بالنية وقيد. بالنية لأنه لا يقع بدونها اتفاقا لكونه من الكنايات، وأشار إلى أنه لا يقوم مقامها دلالة الحال لأن ذلك فيما يصلح جوابا فقط وهو ألفاظ ليس هذا منها. اھ (3/ 283)۔
وفيه ايضا : تحت (قوله وغير ذلك إلخ) مثل: الطلاق عليك، وهبتك طلاقك، (إلی قوله) ففي الكل يقع بالنية رجعي كما في الفتح: زاد في البحر: الطلاق لك أو عليك، أنت طال بحذف الآخر، لست لي بامرأة وما أنا لك بزوج اھ (3/ 303) والله اعلم بالصواب
