What do the learned scholars say about the issue that I got tired of the arguments between us, husband and wife, and I got a divorce certificate prepared. The lawyer signed the divorce certificate on the same day, the day the divorce certificate was made, but the divorce certificate was made in such a way that the wordings of the sentences of divorce were not mentioned. The lawyer had said that if the matter started to escalate, then you should fill in the blank space in the divorce certificate. Now I want to ask whether the divorce occurred due to this divorce certificate or not? Note: My wife does not listen to me, and used to harass me all night, and wake me up while I was sleeping, she used to give me contrasting answers to everything I ask, and despite my prohibition, she used to stand at the window. Although it was not appropriate for the questioner to act hastily in the matter of divorce — in fact, efforts should have been made to resolve domestic disputes through mutual understanding — instead, the questioner wrote down three divorces on the attached divorce deed and signed it.
Therefore, from that day (i.e., December 3rd), all three divorces have taken effect, and an irrevocable divorce (ḥurmat-e-mughallaẓah) has been established. Now, reconciliation (rujū‘) is no longer possible, and without undergoing a proper Shar‘ī ḥalālah, a new marriage between them cannot take place.
Furthermore, after completing her waiting period (‘iddah), the woman is free to marry someone else of her choice.
