Ruling on Purchasing a House in Installments Under a Government Scheme

What do the esteemed Muftis say regarding this matter: The government has introduced a 5 million house scheme, in which I have submitted a form with a fee of 250 rupees. From the submitted forms, a ballot draw will be conducted, and 50 lakh applicants will be selected. The allotted house, whether consisting of 4 rooms or 6 rooms, will then be given on installments. Is this permissible? Considering that the form fee is non-refundable.
Note: It is not clear whether there will be a penalty in case of installment shortfall or not.

الجوابُ حامِدا ًو مُصلیِّا ً

It appears questionable that if only five million houses are to be provided, then why are applications collected from more people than that? However, if there is a legitimate and reasonable purpose for this, and the fee taken from applicants at the time of registration is genuinely to cover expenses—rather than being a means of merely collecting money under the name of registration—then in such a case, participation in the said scheme and purchasing a house on installments is permissible and valid, provided the following conditions are observed:
(1) At the time of contract, it must be clearly decided that the transaction is on credit and installment basis. (2) It must be determined how many installments there will be in total, and the exact amount of each installment. (3) No additional charges should be imposed in case of delay in any installment.

مأخَذُ الفَتوی

كما بحوث في قضايا فقهية معاصرة: لا مانع من أن يطالب البنك مستقرضية بأداء مبلغ مقابل التكلفات الإدارية التي تحملها في تقويم المشروعات, ومتابعة تنفيذها, ما دام ذاك المبلغ لا يجاوز التكلفات الفعلية الواقعة في ذلك المشروع خاصة. فإن كان من الممكن تحديد هذه التكلفات بدقة, فهو الأنسب والأوفق بأحكام الشريعة فإنه لا غبار على جوازه. (ص: 208)۔
و في الدر المختار: (يستحق القاضي الأجر على كتب الوثائق) والمحاضر والسجلات (قدر ما يجوز لغيره كالمفتي) فإنه يستحق أجر المثل على كتابة الفتوى اھ (6/ 92)۔
و في بحوث في قضايا فقهية معاصرة؛ (يستحق القاضي الأجر على كتب الوثائق, والمحاضر, والسجلات قدر ما يجوز لغيره كالمفتي ,فإنه يستحق أجر المثل على كتابة الفتوى اھ (ص: 209)۔
و في فقه البيوع: وكما يجوز ضرب الأجل لأداء الثمن دفعة واحدة، كذلك يجوز أن يكون أداء الثمن بأقساط، بشرط أن تكون أجال الأقساط ومبالغها معينة عند العقد، وقد يسمى البيع بالتقسيط.. وهو نوع من البيع المؤجل اھ (ج 1 ص 539) واللہ اعلم بالصواب
