Respected Mufti Sahib, Assalamu Alaikum wa Rahmatullahi wa Barakatuh! What do the honorable Muftis say regarding this matter: I own a house which I intended to sell. For its purchase, a bank manager came to me, and we began discussing the deal. During this process, a friend of mine, who is a religious scholar, stopped me and said: “Do not make this transaction with him, because his wealth (being unlawful and non-owned in Shariah) is invalid. Any deal with him will not be valid in Shariah. The payment he gives you in exchange for your house will be unlawful for you, and if you purchase anything with that money, it too will remain unlawful. Even charity and donations from such wealth are not accepted.” Therefore, kindly provide a detailed answer in the light of Shariah.
If the said buyer truly possesses some wealth acquired through lawful and permissible means other than income received from the bank, or if he pays the price by taking a loan, then selling the house to him is valid and permissible. Otherwise, it is necessary to abstain from selling it to him.
کما فی الدر المختار: الحرام ينتقل، فلو دخل بأمان وأخذ مال حربي بلا رضاه وأخرجه إلينا ملكه وصح بيعه، لكن لا يطيب له ولا للمشتري منه، الخ (5/98)۔
وفی ردالمحتار: تحت (قوله ولا للمشتري منه) فيكون بشرائه منه مسيئا؛ لأنه ملكه بكسب خبيث،الخ (5/98)۔
و فی ردالمحتار: تحت (قوله وفي الأشباه إلخ) (الی قولہ) سألت عنه الشهاب ابن الشلبي فقال: هو محمول على ما إذا لم يعلم بذلك، أما من رأى المكاس يأخذ من أحد شيئا من المكس، ثم يعطيه آخر ثم يأخذه من ذلك الآخر فهو حرام اهـ. الخ (6/385)۔
